MASTER TRAILER RENTAL AGREEMENT
Version 2.1
This Master Trailer Rental Agreement (“Agreement”) is entered into between EDMOND RENTALS LLC (“Owner,” “Company,” or “Edmond Rentals”) and the individual or entity identified as the renter (“Renter”).
By signing this Agreement, electronically accepting this Agreement, submitting a reservation, making payment, or taking possession of any trailer, equipment, accessory, or related item owned, leased, or managed by Edmond Rentals, Renter agrees to all terms and conditions contained herein.
The Rental Checkout Sheet, Reservation Confirmation, Damage Fee Schedule, Equipment Inventory Sheet, Driver Qualification Form, and any signed addenda are incorporated into and made part of this Agreement.
1. Rental Period
The rental period begins at the designated pickup date and time and ends at the designated return date and time shown on the Rental Checkout Sheet or Reservation Confirmation.
Trailer shall be returned:
- To the designated return location
- On or before the agreed return time
- In substantially the same condition as received, excluding normal wear and tear
- With all accessories, equipment, documents, locks, straps, chains, keys, remotes, ramps, spare tires, and related items included at checkout
No refunds shall be issued for early returns.
2. Late Returns
The trailer must be returned by the exact return time stated in the rental records.
A late fee of $50 per hour shall be charged for each hour or partial hour after the scheduled return time.
If the trailer remains unreturned more than three (3) hours after the return deadline, Edmond Rentals may charge an additional daily rental rate in addition to hourly late fees.
Failure to return the trailer within twenty-four (24) hours of the agreed return time without prior written authorization may result in:
- Recovery actions
- Additional fees
- Notification to law enforcement
- Civil litigation
- Collection activity
- Any other remedies available under applicable law
Renter remains responsible for all rental charges, late fees, loss of rental income, recovery expenses, attorney’s fees, collection costs, and related expenses arising from late or non-return.
3. Eligible Renters and Approved Drivers
Renter represents and warrants that Renter and any approved driver:
- Is at least 25 years old
- Possesses a valid driver’s license
- Possesses all required licenses, endorsements, and qualifications
- Has legal authority to operate the tow vehicle
- Has legal authority to tow the trailer
- Is physically and mentally capable of safely towing and operating the trailer
- Is not impaired by alcohol, drugs, medication, fatigue, or any condition that may affect safe operation
Only approved drivers listed in the rental records may tow, operate, move, load, unload, or possess the trailer.
Edmond Rentals reserves the right to deny or cancel a rental when, in Edmond Rentals’ judgment, the renter, driver, tow vehicle, payment method, insurance status, intended use, destination, cargo, or surrounding circumstances create an unreasonable safety, legal, financial, or operational risk, subject to applicable law.
4. Tow Vehicle Requirements
Renter is solely responsible for ensuring the tow vehicle is properly rated, properly equipped, legally compliant, insured, and safe for the trailer and intended cargo.
Tow vehicle must have:
- Adequate towing capacity
- Adequate payload capacity
- Proper hitch rating
- Proper ball size
- Proper receiver rating
- Proper safety chain connection points
- Functional brake controller when required
- Functional 7-pin electrical connector when required
- Functional lights and signals
- Proper registration
- Valid insurance
- Proper mirrors and visibility
- Tires, brakes, suspension, and drivetrain suitable for the towing operation
Edmond Rentals may inspect tow vehicles but assumes no responsibility for tow vehicle suitability, mechanical condition, legal compliance, towing capacity, payload capacity, hitch rating, or insurance coverage.
Approval to release the trailer does not mean Edmond Rentals has verified or accepted responsibility for the safety, legality, or suitability of the tow vehicle.
5. Insurance Requirements
Renter shall maintain valid automobile liability insurance throughout the rental period.
Renter warrants that their insurance extends coverage to the trailer, towing operation, cargo, driver, and intended use.
Renter remains solely responsible for verifying coverage with their insurance company before taking possession of the trailer.
Failure to maintain insurance shall constitute a material breach of this Agreement.
Renter understands that Edmond Rentals does not provide automobile liability insurance, cargo insurance, physical damage insurance for Renter’s property, or coverage for Renter’s tow vehicle.
Renter remains fully responsible for all loss, damage, injury, claims, liability, and expense not covered by insurance or exceeding available insurance limits.
6. Trailer Condition
Renter acknowledges the trailer has been made available for inspection before departure.
Renter shall inspect the trailer before leaving the rental location.
Renter shall immediately notify Edmond Rentals of:
- Damage
- Defects
- Missing equipment
- Mechanical issues
- Tire issues
- Lighting issues
- Brake issues
- Hydraulic issues
- Coupler, jack, ramp, winch, chain, strap, or accessory issues
Failure to report known or visible issues before departure constitutes acceptance of trailer condition and included equipment.
Renter shall not operate the trailer if Renter believes the trailer is unsafe.
7. Mandatory Photo Documentation
Before leaving the rental location, Renter shall photograph:
- Front
- Rear
- Driver side
- Passenger side
- Tires
- Wheels
- Coupler
- Jack
- Deck
- Fenders
- Lights
- Ramps
- Accessories
- Existing damage
Photos must be submitted to Edmond Rentals before departure unless Edmond Rentals waives this requirement in writing.
Failure to submit required photos constitutes acceptance of trailer condition and responsibility for undocumented damage identified upon return.
Return photos may also be required.
8. Authorized Use
Trailer may only be used for lawful purposes and in a safe, reasonable, and commercially appropriate manner.
Trailer shall not be:
- Sub-rented
- Loaned
- Assigned
- Transferred
- Used by unauthorized drivers
- Used outside the approved operating area, if restricted
- Used in violation of any law, regulation, ordinance, permit requirement, or insurance condition
Only approved drivers listed in rental records may tow or operate the trailer.
9. Prohibited Use
Trailer shall not be used:
- While under the influence of alcohol, drugs, medication, or any impairing substance
- For illegal activities
- In racing, speed contests, stunts, exhibitions, or off-road abuse
- Beyond manufacturer ratings
- Beyond legal weight limits
- Beyond hitch, axle, tire, coupler, jack, ramp, winch, or deck ratings
- To transport hazardous materials unless specifically approved in writing
- To transport stolen property
- To transport persons or animals
- To tow, pull, drag, or recover items in an unsafe manner
- In a manner likely to cause damage, injury, excessive wear, or mechanical failure
Violation of this section may result in immediate termination of the rental, recovery of the trailer, forfeiture of deposit, and additional charges.
10. Loading and Securement
Renter is solely responsible for:
- Cargo selection
- Loading
- Unloading
- Weight distribution
- Gross trailer weight
- Gross combined weight
- Tongue weight
- Cargo securement
- Tie-down methods
- Chain, strap, binder, and anchor point use
- Load height, width, length, and overhang
- Legal compliance during transport
Edmond Rentals does not supervise, approve, inspect, certify, or assume responsibility for loading or securement.
Renter assumes all responsibility for cargo, loading, unloading, weight compliance, securement, and safe transport.
Renter shall not exceed any manufacturer rating, legal rating, posted rating, or equipment limitation.
11. Cargo and Personal Property Disclaimer
Edmond Rentals is not responsible for loss, theft, damage, shifting, contamination, delay, spoilage, destruction, or loss of use of any cargo, vehicle, equipment, material, tool, personal property, or other item transported, loaded, stored, or left on or in the trailer.
Renter is solely responsible for protecting, insuring, securing, and monitoring all cargo and personal property.
12. Damage Responsibility
Renter is financially responsible for:
- Trailer damage
- Tire damage
- Wheel damage
- Axle damage
- Suspension damage
- Brake damage
- Bearing damage
- Coupler damage
- Jack damage
- Ramp damage
- Deck damage
- Fender damage
- Light and wiring damage
- Accessory damage
- Hydraulic damage
- Electrical damage
- Winch damage
- Missing equipment
- Theft
- Vandalism
- Loss
- Fire damage
- Water damage
- Abuse, misuse, neglect, overloading, improper loading, or improper securement
Normal wear and tear is excluded.
Repair charges may include parts, labor, transportation, towing, diagnostic fees, administrative costs, storage fees, loss of rental income, diminished value where applicable, and replacement cost where repair is not reasonable or practical.
Edmond Rentals may use its own repair facility, dealer, mobile repair provider, or other qualified repair vendor.
13. No Unauthorized Repairs
Renter shall not perform, attempt, or authorize welding, tire replacement, hydraulic repairs, electrical repairs, brake repairs, bearing repairs, structural repairs, modifications, painting, drilling, cutting, or alterations without prior written authorization from Edmond Rentals.
Unauthorized repairs may not be reimbursed and may result in additional charges if improper, incomplete, unsafe, or damaging.
14. Continued Operation of Damaged Equipment
Renter shall immediately discontinue operation if:
- Tire failure occurs
- Wheel failure occurs
- Bearing failure occurs
- Brake failure occurs
- Lighting failure occurs
- Hydraulic malfunction occurs
- Structural damage occurs
- Coupler, jack, ramp, chain, strap, or safety equipment failure occurs
- Trailer becomes unsafe or appears unsafe
Continued operation after damage, malfunction, warning signs, abnormal noise, vibration, smoke, dragging, tire failure, brake failure, or unsafe condition may result in additional charges.
Renter is responsible for any additional damage caused by continued operation.
15. Cleaning Fees
Trailer shall be returned reasonably clean.
Cleaning charges may apply for excessive dirt, mud, debris, roofing materials, concrete, paint, chemicals, oil, grease, trash, yard waste, construction debris, animal waste, or any material requiring special cleaning.
Minimum cleaning fee: $50.
Additional charges may apply based on actual cleaning requirements, disposal fees, labor, and materials.
16. Hydraulic Systems
For hydraulic trailers:
- Battery charge levels are not guaranteed
- Hydraulic systems require proper operation
- Renter shall follow all operating instructions
- Renter shall report any malfunction immediately
- Renter shall not force, bypass, modify, overload, or misuse hydraulic components
Damage resulting from misuse, overloading, improper operation, low voltage misuse, forced operation, failure to stop after malfunction, or unauthorized repair shall be charged to Renter.
17. Winch Disclaimer
If the trailer is equipped with a winch, Renter assumes all risks associated with winch operation.
Renter is solely responsible for safe winch use, proper rigging, proper attachment points, load limits, cable or rope condition, safe distance, and bystander safety.
Edmond Rentals is not responsible for injuries, property damage, cargo damage, vehicle damage, or losses resulting from winch use, except where prohibited by law.
18. Accessories and Missing Equipment
All accessories, equipment, straps, chains, binders, locks, keys, remotes, ramps, spare tires, tools, documents, adapters, and related items issued with the trailer must be returned in the same condition, excluding normal wear and tear.
Renter is responsible for replacement cost, repair cost, administrative charges, and loss of rental income resulting from missing, damaged, or unusable equipment.
The Equipment Inventory Sheet and Damage Fee Schedule are incorporated into this Agreement.
19. Security Deposit and Card Authorization
Edmond Rentals may require a refundable security deposit, card authorization hold, or both before releasing the trailer.
Renter authorizes Edmond Rentals to apply the deposit or authorization hold toward unpaid rental charges, late fees, damage charges, cleaning fees, missing equipment, fuel or battery charges if applicable, administrative fees, recovery expenses, towing fees, storage fees, tickets, tolls, fines, impound charges, attorney’s fees, collection costs, loss of rental income, and any other amount owed under this Agreement.
Any remaining deposit balance will be released or refunded after return inspection and final charge review.
Refunds or release of authorization holds may take several business days depending on the payment processor, card issuer, or financial institution.
Deposit acceptance does not limit Renter’s liability. Renter remains responsible for all amounts owed, even if they exceed the deposit or authorization hold.
20. Payment Authorization
Renter authorizes Edmond Rentals to charge any payment method on file for rental fees, late fees, damage charges, cleaning fees, missing equipment, administrative fees, recovery expenses, towing fees, storage fees, tickets, tolls, fines, impound charges, collection costs, attorney’s fees, loss of rental income, and any other amounts owed under this Agreement.
Renter agrees not to dispute valid charges arising under this Agreement.
If a payment is declined, reversed, charged back, or otherwise not paid, Renter remains responsible for the balance, plus any bank fees, processing fees, collection costs, attorney’s fees, and administrative expenses.
21. Tickets, Tolls, Fines, and Impound Fees
Renter is responsible for all tolls, traffic violations, parking tickets, red-light camera tickets, speed camera tickets, overweight violations, bridge or tunnel violations, impound fees, storage fees, citations, fines, penalties, and administrative costs arising during the rental period or while the trailer is in Renter’s possession.
Renter shall promptly notify Edmond Rentals of any ticket, citation, stop, inspection, impound, or violation involving the trailer.
22. Accident, Theft, and Incident Reporting
Renter must immediately notify Edmond Rentals of any accident, theft, suspected theft, damage, loss, injury, police stop, citation, impound, mechanical failure, unsafe condition, insurance claim, third-party claim, property damage, trailer detachment, load shift, tire failure, brake failure, or hydraulic failure.
In the event of an accident, theft, or suspected theft, Renter must contact law enforcement, obtain a police report when available, preserve evidence, take photos, gather witness information, and cooperate with Edmond Rentals, law enforcement, insurers, and claims representatives.
Failure to promptly report an incident may result in additional liability.
23. GPS Tracking
Renter acknowledges that trailers may be equipped with GPS tracking devices, asset trackers, Bluetooth trackers, or similar location technology.
Tracking may be used for theft recovery, asset protection, recovery of overdue equipment, locating missing equipment, verifying general trailer location, and protecting Edmond Rentals’ property rights.
Renter consents to such monitoring.
Renter shall not remove, disable, tamper with, block, damage, or interfere with any tracking device.
Tampering with tracking equipment may result in additional charges and may be reported to law enforcement.
24. Overdue Rental Recovery
If the trailer becomes overdue, Edmond Rentals may attempt contact, disable future rentals, initiate recovery efforts, use GPS or tracking information, enter lawful locations where permitted to recover the trailer, hire towing, recovery, repossession, or legal services, report to law enforcement, pursue civil remedies, and send the account to collections.
Renter remains responsible for all associated costs, including recovery, towing, storage, administrative costs, attorney’s fees, court costs, collection costs, and loss of rental income.
25. Assumption of Risk
Renter acknowledges that towing trailers involves inherent risks, including serious injury, death, property damage, cargo loss, vehicle damage, trailer damage, and third-party claims.
Renter voluntarily assumes all risks associated with towing, hitching, unhitching, loading, unloading, transporting cargo, trailer operation, use of ramps, hydraulic systems, winches, straps, chains, binders, roadway hazards, weather conditions, other drivers, cargo movement, trailer sway, braking distance, backing, and maneuvering.
26. Indemnification
Renter shall defend, indemnify, and hold harmless Edmond Rentals LLC, its owners, members, officers, employees, agents, insurers, successors, assigns, and representatives from and against any claims, demands, losses, damages, injuries, liabilities, fines, penalties, costs, expenses, and reasonable attorney’s fees arising out of or relating to Renter’s rental, possession, use, towing, loading, unloading, transportation, storage, or operation of the trailer.
This includes claims involving personal injury, death, property damage, cargo damage, vehicle damage, traffic violations, towing incidents, loading or unloading incidents, improper securement, overloading, unauthorized drivers, unauthorized use, insurance disputes, and third-party claims.
This indemnification obligation shall apply except to the extent caused by Edmond Rentals’ gross negligence or intentional misconduct.
27. Limitation of Liability
To the fullest extent permitted by law, Edmond Rentals shall not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost business, lost opportunity, delay damages, loss of use, loss of cargo, loss of income, or damage to cargo or personal property.
Edmond Rentals’ total liability, if any, shall not exceed the amount paid by Renter for the rental giving rise to the claim, except where prohibited by law.
Nothing in this Agreement shall limit liability in a manner prohibited by applicable law.
28. No Warranties / As-Is Rental
Except as expressly stated in writing, the trailer and any accessories are rented “as is” and “with all faults.”
Edmond Rentals makes no warranty that the trailer is fit for Renter’s particular purpose, cargo, route, tow vehicle, business use, personal use, or intended use.
Renter is solely responsible for determining whether the trailer is appropriate for Renter’s intended use before departure.
Nothing in this section limits any rights that cannot legally be waived.
29. Reservations, Cancellations, and No-Shows
Reservation, cancellation, and no-show policies may be stated in the Reservation Confirmation, online booking terms, invoice, or written communication from Edmond Rentals. See also our Refund, Cancellation, and Return Policy.
Unless otherwise stated in writing, failure to appear for pickup at the scheduled time may result in cancellation, forfeiture of reservation fees, or other charges.
Edmond Rentals may cancel or refuse release of the trailer if Renter fails to provide required identification, insurance, payment, deposit, tow vehicle, required equipment, or completed paperwork.
30. Approved Operating Area
The trailer may not be removed from the approved operating area listed on the Reservation Confirmation or Rental Checkout Sheet without prior written approval from Edmond Rentals.
If no specific operating area is listed, Renter shall keep the trailer within a reasonable operating distance and shall not remove the trailer from the state or surrounding region without prior written consent.
Unauthorized removal from the approved operating area may result in immediate termination of the rental, recovery of the trailer, additional charges, and denial of future rentals.
31. Default
Renter is in default if Renter fails to return the trailer on time, fails to pay amounts owed, provides false or misleading information, uses the trailer unlawfully or unsafely, allows unauthorized drivers or users, removes the trailer from the approved area without permission, fails to maintain insurance, damages, hides, abandons, or misuses the trailer, tampers with GPS or tracking equipment, or violates any material term of this Agreement.
Upon default, Edmond Rentals may terminate the rental, recover the trailer, charge all amounts owed, pursue collection, report to law enforcement where appropriate, and pursue all legal remedies.
32. Attorney’s Fees and Collection Costs
Renter shall be responsible for reasonable attorney’s fees, court costs, collection costs, recovery costs, administrative fees, and related expenses incurred by Edmond Rentals in enforcing this Agreement or collecting amounts owed.
33. Governing Law and Venue
This Agreement shall be governed by the laws of the State of New Jersey.
Any legal action arising out of or relating to this Agreement shall be brought in the courts of New Jersey, unless another venue is required by law.
34. Severability
If any provision of this Agreement is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.
Any invalid or unenforceable provision shall be interpreted or modified to the minimum extent necessary to make it valid and enforceable, if permitted by law.
35. Entire Agreement
This Agreement, together with the Rental Checkout Sheet, Reservation Confirmation, Damage Fee Schedule, Equipment Inventory Sheet, Driver Qualification Form, and any signed addenda, constitutes the entire agreement between the parties.
No oral statement, promise, representation, or agreement shall modify this Agreement unless confirmed in writing by Edmond Rentals.
Website policies including our Terms and Conditions and Privacy Policy apply to booking and website use. If there is a conflict regarding a specific rental, this signed Agreement controls.
36. Electronic Signatures
Electronic signatures, electronic acceptance, online reservations, digital acknowledgements, checkbox acceptance, typed names, scanned signatures, and similar electronic records shall have the same legal force and effect as handwritten signatures to the fullest extent permitted by law.
37. Acknowledgement
By signing below, Renter acknowledges:
- Renter has read this Agreement
- Renter understands this Agreement
- Renter agrees to be bound by this Agreement
- Renter had an opportunity to inspect the trailer
- Renter accepts responsibility for safe and lawful use
- Renter assumes all responsibilities described herein
- Renter understands that towing involves serious risk
- Renter understands that Edmond Rentals is relying on Renter’s statements, insurance, tow vehicle suitability, and safe operation
